Artwork Listings Policies
Artwork listings are the foundation of the Artsays marketplace, enabling artists to showcase and offer their artworks to buyers and collectors. To maintain a transparent, trustworthy, and high-quality marketplace, every listing must accurately represent the artwork being offered and comply with all applicable Artsays policies and legal requirements.
Artists are solely responsible for the accuracy, completeness, legality, originality, and authenticity of every artwork listing they publish. Artsays reserves the right to review, request modifications to, restrict, suspend, hide, or remove any listing that does not comply with platform policies, applicable laws, marketplace standards, or the interests of the Artsays community.
3.1 Listing Requirements
Artists may create listings only for artworks they have personally created or are legally authorized to represent and sell.
Each artwork listing must be complete, accurate, and created in accordance with Artsays' listing standards. Artists must provide all mandatory information requested during the listing process and ensure that every listing truthfully represents the artwork being offered.
Listings must not contain false, misleading, deceptive, duplicated, incomplete, or inaccurate information. Artists must not create duplicate listings or manipulate listings in a manner intended to unfairly influence search visibility, pricing, bidding, availability, or marketplace performance.
Artists are responsible for ensuring that all listed artworks comply with applicable laws, Artsays policies, and any applicable intellectual property, authenticity, and content requirements.
3.2 Artwork Details & Disclosure
Artists are responsible for providing complete, accurate, and up-to-date information for every artwork listed on Artsays.
Artwork details may include, where applicable:
- Artwork title.
- Category and sub-category.
- Medium and materials.
- Dimensions and weight.
- Year of creation.
- Style and subject.
- Originality status.
- Edition type and edition number.
- Certificate of Authenticity (where applicable).
- Framing information.
- Artwork condition.
- Price.
- Shipping information.
- Other specifications required by Artsays.
Artists must accurately disclose all material information relating to an artwork so that buyers can make informed purchasing decisions.
Descriptions must not contain exaggerated, misleading, or false claims regarding originality, authenticity, rarity, investment potential, provenance, market value, awards, or artistic significance.
Where an artwork has been restored, repaired, modified, reproduced, digitally enhanced, AI-assisted, or possesses any other material characteristic that may influence a buyer's decision, such information should be clearly disclosed wherever applicable.
Artists remain responsible for updating artwork information whenever any material change occurs.
3.3 Images
Images are an essential part of every artwork listing and should accurately represent the actual artwork being offered.
Artists should upload clear, high-quality images that truthfully depict the artwork's colours, proportions, texture, framing (where applicable), condition, and overall appearance.
Images must not:
- Misrepresent the artwork.
- Be excessively edited in a manner that materially alters the appearance of the artwork.
- Contain misleading graphics, promotional overlays, pricing information, or unrelated visual elements.
- Include unauthorized watermarks, logos, or branding that obstruct the artwork unless expressly permitted by Artsays.
- Infringe the intellectual property rights of any third party.
Additional photographs showing framing, signatures, certificates, close-up details, or different viewing angles may be included where they assist buyers in evaluating the artwork.
Artsays reserves the right to reject or request replacement of images that do not satisfy platform quality standards.
3.4 Pricing
Artists have the sole responsibility for determining the selling price of their artworks while ensuring that pricing remains fair, transparent, accurate, and compliant with applicable Artsays policies.
Pricing must accurately represent the artwork being offered and must not involve deceptive pricing practices, artificial price inflation, false discounts, misleading promotional claims, or any other practice intended to mislead buyers.
Where applicable, artists should clearly indicate whether applicable taxes, framing charges, packaging charges, shipping costs, insurance charges, installation fees, or other additional costs are included in the listed price or charged separately.
Artsays reserves the right to review, suspend, or remove listings containing obvious pricing errors, misleading pricing information, or pricing practices that violate applicable laws or platform policies.
3.5 Artwork Availability
Artists are responsible for ensuring that the availability status of each listed artwork remains accurate and up to date throughout the listing period.
Where an artwork has been sold, reserved, withdrawn, or is otherwise no longer available for purchase, the artist should promptly update or remove the listing to prevent unsuccessful orders and buyer inconvenience.
For artworks offered in multiple editions or limited quantities, artists are responsible for accurately maintaining the available quantity and ensuring that buyers are not able to purchase unavailable artworks.
Artists should take reasonable steps to avoid duplicate listings, overselling, or accepting orders for artworks that cannot be fulfilled.
Repeated failures to maintain accurate artwork availability may result in order cancellations, buyer dissatisfaction, and corrective actions in accordance with applicable Artsays policies.
3.6 Listing Updates
Artists are responsible for ensuring that their listings remain accurate, complete, and current throughout the duration of their publication on Artsays.
Whenever there are material changes relating to an artwork—including its price, availability, dimensions, condition, images, certificates, editions, framing, shipping information, or any other listing detail—the listing must be updated without unreasonable delay.
Artsays may periodically review listings to ensure continued compliance with platform standards and may request corrections where necessary.
3.7 Listing Review & Removal
Artsays reserves the right to review any artwork listing at any time to ensure compliance with applicable laws, platform policies, marketplace standards, and the overall integrity of the platform.
Where a listing is found to contain inaccurate information, misleading content, policy violations, intellectual property concerns, authenticity issues, prohibited content, pricing irregularities, or other non-compliant information, Artsays may, at its sole discretion:
- Request modifications or additional information.
- Temporarily hide or disable the listing.
- Reject the listing before publication.
- Remove the listing from the platform.
- Restrict future listing privileges.
- Take additional enforcement actions in accordance with applicable Artsays policies.
Where reasonably practicable, Artsays may notify the artist of the action taken and provide an opportunity to correct the identified issues. However, Artsays reserves the right to remove or restrict listings immediately where necessary to protect buyers, comply with legal obligations, prevent fraud, or maintain the integrity and reputation of the platform.
