Artwork Eligibility & Content Standards Policies

Artsays is committed to maintaining a marketplace that promotes originality, creativity, authenticity, transparency, and respect for intellectual property rights. These Artwork Eligibility & Content Standards establish the minimum requirements that every artwork must satisfy before it can be listed, displayed, promoted, or sold on the Artsays platform.

Artists are responsible for ensuring that every artwork complies with these standards, all applicable Artsays policies, and relevant laws. Artsays reserves the right to review, verify, restrict, suspend, reject, or remove any artwork or listing that does not comply with these requirements or that may negatively impact the integrity, safety, or reputation of the platform.

4.1 Original Artwork

Artists listing an artwork as "Original" represent and warrant that the artwork is their own original creative work and has not been copied, traced, replicated, forged, or otherwise created in violation of another person's intellectual property rights.

Artists must accurately represent the originality status of every artwork. Where applicable, the listing should clearly identify whether the artwork is:

False, misleading, or inaccurate declarations regarding originality are strictly prohibited and may result in listing removal, account restrictions, suspension, or other enforcement actions under applicable Artsays policies.

4.2 AI-Generated Artwork

Artsays supports responsible innovation while promoting transparency and informed purchasing decisions.

Where an artwork has been created wholly or partially using Artificial Intelligence (AI), generative AI tools, machine learning systems, or similar technologies, artists must clearly disclose the nature and extent of AI involvement within the artwork listing wherever applicable.

Artists remain solely responsible for ensuring that AI-generated or AI-assisted artworks:

Failure to disclose material AI involvement or intentional misrepresentation of AI-generated artworks may result in listing restrictions, removal, suspension, or other enforcement measures.

4.3 Fan Art

Fan art may be listed on Artsays only where its creation, display, and sale comply with applicable intellectual property laws and the rights of the original copyright or trademark owner.

Artists are responsible for ensuring that they possess all permissions, licences, authorizations, or other legal rights required to commercially display or sell fan art where such permissions are required.

Fan art must not falsely imply sponsorship, endorsement, affiliation, collaboration, approval, or association with the original creator, copyright owner, trademark owner, brand, franchise, or rights holder.

Artsays reserves the right to request supporting documentation or remove fan art listings where ownership rights are disputed or legal authorization cannot be reasonably demonstrated.

4.4 Copyright Compliance

Artists must ensure that every artwork, image, design, title, description, certificate, and all other content uploaded to Artsays complies with applicable copyright laws and intellectual property regulations.

Artists must not upload, reproduce, copy, distribute, sell, display, or otherwise use copyrighted material belonging to another person without the necessary rights, permissions, or legal authorization.

Artists remain solely responsible for obtaining all licences, permissions, authorizations, and consents necessary for the creation, publication, promotion, and sale of their artworks.

Where Artsays receives a valid intellectual property complaint or otherwise identifies potential infringement, it may investigate the matter and take appropriate action, including requesting additional information, temporarily restricting the listing, removing the content, or applying other enforcement measures under applicable Artsays policies.

4.5 Restricted Artwork

To maintain a safe, lawful, and trusted marketplace, certain categories of artwork are prohibited from being listed, promoted, or sold on Artsays.

Restricted artworks include, but are not limited to, artworks that:

Artsays reserves the right to determine whether an artwork is appropriate for listing on the platform and may reject, remove, restrict, or permanently prohibit any artwork that does not meet these standards.

4.6 Disclosure of Material Characteristics

Artists must disclose any material characteristic of an artwork that could reasonably influence a buyer's purchasing decision.

Where applicable, artists should accurately disclose information including, but not limited to:

Failure to disclose material characteristics that could reasonably affect a buyer's decision may be considered misrepresentation and may result in listing corrections, buyer remedies, listing removal, account restrictions, or other enforcement actions under applicable Artsays policies.
