Seller Eligibility Policies
The Seller Eligibility Policy outlines the requirements for individuals and businesses wishing to sell artworks or other eligible products through the Artsays marketplace. These requirements help maintain a secure, transparent, and trusted marketplace while ensuring compliance with applicable legal, financial, and operational standards.
Only sellers who satisfy the eligibility, verification, and compliance requirements established by Artsays may offer products for sale on the platform.
1.1 Eligibility
To register as a seller on Artsays, applicants must meet the eligibility requirements specified by the platform and applicable laws.
Sellers must:
- Be legally permitted to enter into binding contracts under applicable law.
- Provide complete, accurate, and up-to-date registration information.
- Maintain a valid Artsays account in good standing.
- Have the legal right to sell, distribute, or otherwise offer the listed products.
- Comply with all applicable Artsays policies throughout their participation on the platform.
Where a seller operates on behalf of a business, gallery, organisation, partnership, or other legal entity, the individual creating the account must be duly authorised to act on behalf of that entity.
Artsays reserves the right to determine seller eligibility and may approve, reject, suspend, or revoke seller access where eligibility requirements are not satisfied.
1.2 Business Verification
To maintain marketplace integrity and comply with applicable legal and regulatory requirements, Artsays may require sellers to complete business verification before accessing certain selling features or receiving payouts.
Business verification may include verification of:
- Business or organisation details, where applicable.
- Identity of the authorised representative.
- Business registration documents, where applicable.
- Bank account verification.
- Tax registration details, where applicable.
- Any other documentation reasonably required to verify the seller's identity or business operations.
Sellers are responsible for ensuring that all information and supporting documents submitted during the verification process are accurate, complete, valid, and kept up to date.
Failure to complete verification or submission of false, misleading, expired, or fraudulent information may result in delays, restrictions, suspension, or termination of seller privileges in accordance with applicable Artsays policies.
1.3 Tax Compliance
Sellers are solely responsible for complying with all applicable tax laws, statutory obligations, and regulatory requirements relating to the sale of products through the Artsays platform.
Where required by applicable law, sellers must provide valid tax information, including PAN, GST registration details (where applicable), and any other information reasonably required for regulatory compliance or payment processing.
Sellers are responsible for:
- Issuing invoices where required by law.
- Maintaining accurate financial and tax records.
- Filing applicable tax returns.
- Paying all taxes, duties, levies, and statutory charges applicable to their business activities.
Where legally required, Artsays may collect, deduct, withhold, report, or remit applicable taxes or statutory deductions in accordance with applicable laws.
Failure to comply with applicable tax or regulatory requirements may result in restrictions on seller activities, delayed payouts, suspension of selling privileges, or other actions permitted under applicable Artsays policies.
