Violations & Enforcement Policies
The Violations & Enforcement Policy explains the actions Artsays may take where an artist fails to comply with these policies, applicable laws, or the terms governing use of the platform.
Artsays aims to maintain a fair, secure, and trustworthy marketplace for all users. Where a policy violation is identified, Artsays may investigate the matter and take appropriate enforcement action based on the nature, severity, frequency, and impact of the violation.
Nothing in this policy limits Artsays' rights to take immediate action where necessary to protect users, comply with legal obligations, prevent fraud, or maintain the integrity and security of the platform.
8.1 Policy Violations & Warnings
Where appropriate, Artsays may notify an artist of a policy violation and provide an opportunity to correct the issue before further enforcement action is taken.
Warnings may be issued for first-time, minor, or unintentional violations, including inaccurate listings, incomplete information, delayed fulfilment, or other non-material breaches of platform policies.
Artists are expected to promptly address any issues identified by Artsays and take reasonable steps to prevent repeated violations.
Repeated warnings or failure to take corrective action may result in additional enforcement measures under these policies.
8.2 Listing Restriction & Removal
Artsays reserves the right to review, restrict, suspend, hide, reject, or remove any artwork listing that violates applicable policies, infringes intellectual property rights, contains misleading information, presents safety concerns, or otherwise fails to meet the standards of the platform.
Where reasonably practicable, Artsays may request that the artist correct or update the listing before removing it. However, Artsays may immediately restrict or remove a listing where urgent action is necessary to protect users, comply with legal obligations, prevent fraud, or maintain marketplace integrity.
Removal of a listing does not prevent Artsays from taking additional enforcement action where appropriate.
8.3 Account Suspension
Artsays may temporarily suspend an artist's account or restrict access to certain platform features where reasonably necessary to:
- Investigate suspected fraud, policy violations, or unlawful activity.
- Complete identity or compliance verification.
- Protect buyers, other users, or the platform.
- Resolve disputes or regulatory requirements.
- Prevent continued misuse of the platform.
During a suspension, artists may be temporarily restricted from listing artworks, accepting orders, receiving payouts, or accessing certain platform services until the matter has been resolved.
Artsays will make reasonable efforts to notify the artist of the suspension where appropriate and permitted by law.
8.4 Account Termination
Artsays reserves the right to permanently terminate an artist's account where serious or repeated violations of these policies occur, including but not limited to fraud, intentional misrepresentation, repeated intellectual property infringement, unlawful activities, abuse of the platform, or other conduct that materially harms Artsays, its users, or the marketplace.
Where reasonably practicable, Artsays may notify the artist before terminating the account. However, immediate termination may occur where required to comply with applicable laws, protect users, prevent fraud, or safeguard the security and integrity of the platform.
Termination of an account does not affect any rights, obligations, liabilities, pending investigations, financial adjustments, or legal remedies that arose prior to the termination of the account.
