AI, Blockchain & Digital Assets Policies
The AI, Blockchain & Digital Assets Policy explains how Artsays supports AI-related artwork disclosures, AI-assisted creation, blockchain-based records, digital asset representations, and emerging digital ownership technologies within the marketplace. This policy applies to artworks, digital works, certificates, blockchain records, NFTs, and other digital asset-related services that may be offered through the Artsays platform from time to time.
Artsays aims to promote transparency, responsible use of technology, and trust within the marketplace while supporting innovation across both traditional and digital art ecosystems.
5.1 AI Artwork Disclosure
Artists and sellers must accurately disclose whether an artwork has been created using artificial intelligence, generated entirely through AI systems, or materially assisted by AI tools where such disclosure is required by Artsays.
AI-generated and AI-assisted artworks may be listed on the platform where permitted by applicable Artsays policies, provided that the artist or seller accurately represents the method of creation and complies with all applicable intellectual property, copyright, licensing, and platform requirements.
Failure to accurately disclose AI involvement where required may result in listing review, correction, suspension, removal, or other enforcement actions under the applicable Artsays policies.
5.2 AI-Assisted Creation
Artsays recognises that artists may use AI tools as part of their creative process, including concept development, composition assistance, colour exploration, editing, enhancement, restoration, reference generation, or other creative workflows.
Use of AI-assisted creative tools does not automatically affect eligibility for listing on the platform, provided that the artist or seller complies with applicable disclosure requirements, intellectual property laws, licensing obligations, and other applicable Artsays policies.
Artsays may require additional information regarding the extent of AI involvement where reasonably necessary for transparency, authenticity review, buyer information, or policy compliance.
5.3 Blockchain Records
Artsays may create or maintain blockchain-based records associated with artworks, Certificates of Authenticity (COAs), provenance information, transaction references, verification records, or other authenticity-related data.
Blockchain records are intended to improve transparency, traceability, and integrity of authenticity-related information and may include cryptographic references, hashes, timestamps, certificate identifiers, or other verification-related data determined by Artsays.
A blockchain record supports documentation and record integrity but does not independently establish ownership, copyright, legal title, market value, authenticity, or other legal rights unless expressly provided by applicable law or separate contractual arrangements.
5.4 NFTs & Tokenized Assets
Where supported by Artsays, digital artworks, blockchain-linked artworks, NFTs, tokenized assets, or other blockchain-based digital representations may be listed, transferred, displayed, or otherwise supported through the platform.
Any NFT, token, or blockchain-based digital asset associated with an artwork represents only the rights expressly described in the applicable listing, certificate, smart contract, or accompanying documentation.
Ownership of an NFT or tokenized asset does not automatically transfer copyright, reproduction rights, commercial rights, trademark rights, moral rights, or other intellectual property rights unless such rights are expressly granted in writing by the rights holder.
Artsays may impose additional eligibility, verification, technical, compliance, or blockchain-network requirements for NFT and tokenized asset transactions.
5.5 Digital Ownership
Unless expressly stated otherwise, the purchase of a digital artwork, blockchain-linked artwork, NFT, tokenized asset, Certificate of Authenticity, or other digital asset through Artsays grants the buyer ownership only of the specific digital asset or transferable rights expressly identified in the relevant transaction documentation.
Copyright, intellectual property rights, reproduction rights, commercial exploitation rights, licensing rights, and other proprietary rights remain with the artist, creator, rights holder, or other authorised owner unless expressly transferred through a separate written agreement.
Buyers are responsible for understanding the rights associated with any digital asset purchased through Artsays before completing the transaction, and Artsays may provide supporting documentation or explanatory information where reasonably appropriate.
