Collector Policies
1. Collector Eligibility
The Collector Eligibility Policy outlines the requirements for individuals, institutions, galleries, organisations, and other entities purchasing artworks through Artsays for collection, investment, exhibition, archival, or long-term ownership purposes.
Collectors are expected to comply with all applicable Artsays policies, payment requirements, legal obligations, and transaction procedures applicable to artwork purchases made through the platform.
Artsays may require additional verification for certain transactions, high-value purchases, provenance-related requests, or other situations where enhanced verification is reasonably necessary.
2. Provenance & Ownership Records
Collectors are encouraged to maintain accurate records relating to the ownership, acquisition, transfer, and provenance of artworks purchased through the Artsays platform.
Where provenance documentation, ownership history, exhibition records, publication references, or other supporting documentation accompanies an artwork, collectors should preserve such records for future authentication, resale, insurance, valuation, exhibition, or legal purposes.
Collectors should not intentionally alter, misrepresent, falsify, or remove provenance information associated with an artwork where such information forms part of the documented ownership history or authenticity records.
Where ownership of an artwork is transferred, collectors are encouraged to transfer relevant provenance documentation and accompanying authenticity records to the subsequent owner where appropriate.
3. Certificate of Authenticity (COA) Management
Where an artwork is accompanied by a Certificate of Authenticity (COA), collectors are responsible for preserving the certificate and any associated verification records provided through the Artsays platform.
Collectors should retain the COA together with the artwork and avoid alteration, damage, or unauthorised reproduction of authenticity documentation.
Where applicable, collectors may be required to provide the original COA or verification information when requesting resale, provenance verification, insurance documentation, valuation support, or other authenticity-related services available through Artsays.
Loss or damage of a certificate may affect future verification or resale processes, subject to the applicable Artsays policies.
4. High-Value Artwork Purchases
Certain artwork transactions may be designated by Artsays as high-value purchases based on factors such as transaction value, rarity, provenance significance, artist recognition, or other criteria determined by the platform.
For such transactions, Artsays may require additional verification, identity documentation, payment confirmation procedures, compliance reviews, enhanced due diligence, or other reasonable measures to ensure transaction security and regulatory compliance.
Collectors agree to cooperate with any additional verification or documentation requirements applicable to high-value artwork purchases.
Failure to complete required verification procedures may result in delays, temporary holds, cancellation of the transaction, or other actions permitted under applicable Artsays policies and legal requirements.
5. Private Collections & Confidentiality
Artsays respects the privacy of collectors and recognises that many artwork acquisitions are intended for private collections, confidential ownership, or personal investment purposes.
Subject to applicable laws and operational requirements, Artsays will make reasonable efforts to protect collector information and limit disclosure of confidential transaction details.
Collectors should also take reasonable measures to protect the confidentiality of ownership records, provenance documentation, certificates, valuations, and other sensitive information associated with their collections.
Nothing in this policy prevents Artsays from disclosing information where required by law, court order, regulatory obligation, fraud investigation, payment processing, logistics operations, insurance requirements, or other legitimate legal or operational purposes.
6. Resale & Transfer Responsibilities
Collectors are responsible for ensuring that any future resale, transfer, donation, inheritance, consignment, or other disposition of artworks acquired through Artsays is conducted lawfully and accurately.
Where an artwork is resold or transferred, collectors should make reasonable efforts to provide accurate provenance information, authenticity documentation, Certificates of Authenticity (where available), and other material information relevant to the artwork.
Collectors must not knowingly misrepresent the authenticity, ownership history, condition, edition status, provenance, or value of an artwork during any resale or transfer process.
Where future resale occurs through the Artsays platform, collectors must comply with the applicable seller, listing, authenticity, verification, and transaction policies then in effect.
Artsays may refuse, restrict, or remove resale listings where authenticity, provenance, ownership, or legal compliance concerns reasonably arise.
