Intellectual Property Policies

Artsays respects and is committed to protecting intellectual property rights. This Intellectual Property Policy explains the ownership, use, protection, and enforcement of intellectual property on the Artsays platform.

Artists, sellers, buyers, collectors, galleries, and all other users are responsible for ensuring that any content, artwork, images, logos, text, designs, or other materials they upload, publish, sell, or otherwise make available through Artsays do not infringe the intellectual property rights of any third party.

Artsays reserves the right to investigate, restrict, remove, disable, or take appropriate action against any content or account that violates this policy or applicable intellectual property laws.

4.1 Ownership

Users retain ownership of the intellectual property rights in the content, artworks, images, designs, logos, text, and other materials they create and upload to Artsays, unless otherwise agreed in writing.

By uploading content to the platform, users represent and warrant that they own the content or possess all necessary rights, licenses, permissions, and authorizations required to publish, display, sell, or otherwise make the content available through Artsays.

Nothing in these policies transfers ownership of a user's intellectual property to Artsays. However, by using the platform, users grant Artsays a limited, non-exclusive, worldwide, royalty-free, revocable license to host, display, reproduce, distribute, promote, and use such content solely for operating, marketing, improving, and providing the Artsays platform and related services.

4.2 Copyright

Users must respect the copyrights of artists, creators, rights holders, and third parties at all times.

Users must not upload, reproduce, copy, trace, modify, distribute, sell, display, or otherwise use copyrighted works without proper authorization from the copyright owner or where otherwise permitted by applicable law.

The sale or listing of counterfeit, plagiarized, unauthorized reproductions, or infringing works is strictly prohibited.

Where Artsays receives a valid copyright infringement complaint, it may investigate the matter and temporarily or permanently remove the reported content, restrict associated listings, suspend transactions, or take other appropriate actions pending review.

4.3 Trademark

Users must not use trademarks, trade names, logos, service marks, brand identities, or other protected identifiers belonging to Artsays or any third party without appropriate authorization.

Users must not falsely suggest sponsorship, endorsement, partnership, affiliation, certification, or association with Artsays or any other individual, organization, gallery, institution, or brand.

Any unauthorized use of trademarks or branding may result in content removal, account restrictions, or legal action where appropriate.

4.4 License to Use Content

By submitting content to Artsays, users grant Artsays a limited, non-exclusive, royalty-free, worldwide, revocable license to store, reproduce, publish, display, distribute, adapt for technical purposes, and promote such content solely for operating, maintaining, improving, securing, marketing, and providing the platform and its services.

This license does not transfer ownership of the user's intellectual property and may be withdrawn by removing the content from the platform, subject to legal, operational, contractual, or archival requirements.

Artsays will not commercially exploit or license user content to third parties outside the operation and promotion of the platform without obtaining any additional permissions required by applicable law or contractual agreements.

4.5 Infringement Reporting

If any individual or organization believes that content available on Artsays infringes their intellectual property rights, they may submit a written infringement report through Artsays' official reporting channels.

An infringement report should include sufficient information to enable Artsays to reasonably investigate the claim, including:

Artsays may request additional information before taking action and reserves the right to reject incomplete, unsupported, or abusive complaints.

4.6 Counter-Notice

A user whose content has been removed or restricted following an intellectual property complaint may submit a counter-notice if they believe the action was taken in error or that they have lawful rights to use the reported content.

The counter-notice should include sufficient information and supporting evidence explaining why the content should be restored.

Artsays may review the counter-notice alongside the original complaint and any supporting information before determining whether the content should remain removed, be reinstated, or be subject to further investigation.

Submission of a counter-notice does not guarantee reinstatement of content, and Artsays reserves the right to make the final platform decision in accordance with applicable laws and these policies.

4.7 Repeat Infringers

Artsays maintains a zero-tolerance approach toward repeated or intentional intellectual property violations.

Users who repeatedly upload infringing content, receive multiple valid infringement complaints, intentionally misrepresent ownership, or otherwise misuse the platform may be subject to progressive enforcement actions, including:

Artsays may determine appropriate enforcement measures based on the nature, severity, frequency, and impact of the violations and reserves the right to take immediate action where necessary to protect intellectual property rights and maintain the integrity of the platform.
